2. Subject Matter
This agreement governs the rights and obligations of the parties regarding the sale and delivery of the ready-made software or digital product ordered electronically on oxoyazilim.com. It is subject to Law No. 6502 and the Regulation on Distance Contracts.
3. Pre-Contract Information: Product and Price
The main characteristics and scope of the product are shown on the relevant package page before ordering. The total price (including VAT) and any additional items are shown to the Buyer on the order summary before payment. The Seller does not change this price unilaterally after the order is placed.
Because the product is delivered electronically, no shipping or delivery fee is charged.
4. Pre-Contract Information: Payment
Payment is made with the methods offered at checkout: credit card (through the iyzico infrastructure) or bank transfer. Card details are not stored by the Seller. Details are available on the Payment Methods and Payment Security pages.
5. Delivery and Performance
The product is not shipped physically; it is delivered electronically through the Seller's automatic delivery system. Once payment is confirmed, the download link, licence details and any required access information are made available immediately in the Buyer's member portal and at the e-mail address given at checkout.
The Seller delivers the product within the maximum period of thirty days set by the Regulation on Distance Contracts. Where the product is delivered instantly, performance is complete at the moment of delivery.
6. Right of Withdrawal and Its Exception
If the Buyer is a consumer, they would in principle have the right to withdraw within fourteen days of delivery without giving a reason. However, under Article 15(1)(ğ) of the Regulation on Distance Contracts, no right of withdrawal exists for services performed instantly in electronic form or intangible goods delivered instantly to the consumer.
The ready-made software and digital products offered by the Seller are intangible goods delivered instantly. By ticking a separate checkbox at checkout, the Buyer acknowledges that the product will be delivered instantly once payment is confirmed, gives prior express consent to performance starting, and accepts that no right of withdrawal applies. The order cannot be completed without this consent.
This is consistent with our cancellation and refund policy: no refunds are made for digital products that have been paid for and delivered. Cancelling an order before payment is free of charge.
7. Buyer Who Is a Merchant or Company
If the Buyer is a merchant, company or other legal entity acting for commercial or professional purposes, the consumer rights granted by Law No. 6502, including the provisions on withdrawal, do not apply. In that case the Turkish Code of Obligations and the Turkish Commercial Code apply to the agreement and the Buyer has no right of withdrawal.
8. Defective Performance and Support
If the delivered product deviates materially from the scope stated on the order page, the Buyer may notify [email protected] quoting the order number, and the Seller will try to remedy the defect free of charge within a reasonable time. Mandatory consumer rights under law are reserved. The duration and scope of technical support are set out in the Software License Agreement.
9. Licence and Intellectual Property
The right to use the purchased software is governed separately by the Software License Agreement, which the Buyer is also deemed to accept when confirming the order. Intellectual property rights in the software remain with the Seller.
10. Protection of Personal Data
The Buyer's personal data is processed as described in the KVKK Information Notice and the Privacy Policy.
11. Dispute Resolution
If the Buyer is a consumer, the Consumer Arbitration Committees and Consumer Courts at the Buyer's or the Seller's place of residence are competent within the monetary limits announced each year by the Ministry of Trade. If the Buyer is a merchant or company, the courts and enforcement offices of Aydın are competent.
12. Entry into Force and Records
The agreement is concluded and enters into force electronically when the Buyer ticks the relevant checkbox at checkout and completes the order. The acceptance date, agreement version and IP address are recorded as evidence; the Buyer can view them in the order details in the member portal.
