2. Scope and Brief

The scope is defined by the package content on the order page, the notes the Client submits with the order, and the brief confirmed in writing (including by e-mail). Work outside the scope and later requests are quoted separately and not started until approved.

3. Work Plan and Payment Schedule

The service fee is shown in the order summary. Unless otherwise agreed in writing, the fee is paid at checkout and work starts after payment is received. If the parties agree on a milestone payment plan in writing, each milestone is paid on the dates in the plan, tied to approval of that milestone. If payment is late after a milestone delivery, work on the next milestone does not proceed.

4. Client Obligations

The Client provides content, images, logos, access details and feedback on time. Delays in these materials extend the delivery time accordingly. The Client is responsible for the lawfulness of the content it supplies and for ensuring it does not infringe third-party rights.

5. Delivery and Acceptance

The Service Provider presents the work or each milestone to the Client in a test environment or live. If the Client does not report concrete omissions or defects in writing within 7 days of delivery, the work is deemed accepted. Reported defects are fixed within a reasonable time. Going live replaces acceptance.

6. Revisions

Unless the package states otherwise, two (2) rounds of revisions within the approved brief are free of charge. A revision means correction and fine-tuning against the approved scope; new features, new pages or redoing the design from scratch are not revisions and are charged separately.

7. Delivery Time and Delay

The estimated delivery time is stated on the order or package page and depends on the Client providing materials and approvals on time. For delays caused by the Service Provider that exceed a reasonable time, the parties agree a new schedule; if the delay continues, the Client may terminate by written notice. Force majeure is not delay.

8. Intellectual Property

The rights of use and reproduction in the parts of the deliverable developed specifically for the Client pass to the Client once the full service fee is paid. The Service Provider's pre-existing libraries, frameworks, templates and general-purpose components remain with the Service Provider; the Client may use them as part of the deliverable. Third-party licensed components remain subject to their own licence terms. Unless the Client objects in writing, the Service Provider may show the completed work in its portfolio as a reference.

9. Confidentiality

The parties keep confidential any commercial, technical and personal information learned in connection with the service, during and after the agreement, use it only to perform the agreement and do not share it with third parties. Disclosures required by public authorities are an exception.

10. Hosting and Maintenance

Hosting, domain, backups and maintenance and support after delivery are outside the scope of this agreement; they are offered and charged as separate services. If hosting is selected at checkout, it is invoiced separately and the SaaS Subscription Agreement or the written terms agreed by the parties apply.

11. Fee and Refund

As stated on the Cancellation and Refund page, once payment is received and work has begun with the Client's approval, the fee paid is not refunded. Cancelling an order before payment is free of charge. If the Client is a consumer, mandatory statutory rights are reserved; the Regulation on Distance Contracts provides that withdrawal cannot be exercised for services whose performance has begun with the consumer's approval. If the Client is a merchant or company, consumer-law withdrawal rights do not apply.

12. Termination

Either party may terminate if a breach is not remedied within 10 days of a written warning. On termination the Service Provider is entitled to the fee for work completed up to that point; refund of any fee already paid is subject to the Cancellation and Refund terms. On termination, the rights in completed and paid-for parts pass to the Client.

13. Liability

Except in cases of intent or gross negligence and cases that cannot be limited by law, the Service Provider's total liability under this agreement is limited to the fee paid for the relevant service. No liability is accepted for indirect damages, loss of profit or data loss.

14. Governing Law and Jurisdiction

Turkish law applies. The courts and enforcement offices of Aydın are competent; if the Client is a consumer, the jurisdiction rules of consumer legislation are reserved.

15. Entry into Force and Records

The agreement enters into force when the Client ticks the checkbox at checkout and completes the order. The acceptance date, version and IP address are recorded.
